The fence line shows where the fence is actually located. If the fence is not on the deed line, then it will typically require both a lawyer and a surveyor to determine where the boundary line should b and whether the fence can be moved. Can you still steal someone’s land by possession? This is called Adverse Possession and is still available today in many parts of Ontario. However, it is getting harder to prove. Since most of the land has been converted into the Land Titles System, it now will take typically at least 20 years to be able to prove that you have taken your neighbour’s land by possession. Sorry, you cannot steal land from the government, so even if you have fenced in some City land or Conservation land for 30 years, you can be asked to move the fence back if they find out. Who owns the tree on the property line? If the tree is on the boundary line, then both neighbours own the tree. You cannot remove the tree without the permission of both owners. You can trim the branches or the roots of your neighbour’s tree to the property line, as long as you do not harm the tree. You cannot enter your neighbour’s land to do this. If your tree falls and damages your neighbour’s property, then your neighbour will be responsible for the loss and will have to claim from their own insurance policy. Strange result but true. Is there a law that there must be a fence on the boundary line? Unless you have a swimming pool or your land is backing onto a public highway, there is no law saying you must have a fence. If there are disagreements between neighbours over the type of fence to build, or whether a fence needs to be rebuilt, then each City has a process to decide this. Some cities send out referees to determine who is right. The reasonable solution is just share the cost of a simple fence. If one neighbour wants a more elaborate fence, let them pay the difference. What should you do when an argument erupts over a boundary line? I have seen neighbours come close to physical violence over arguments about boundary lines. I have seen cases where people just take matters into their own hands, rip up the fence and build it on a different boundary line. Although the best answer is to get a new survey and work it out, that may not always be possible. Having spoken to police officers/detectives/inspectors and many solicitors, Attorney's General's office, The magistrates courts, Home office for HOC policies. The IPCC ???, CPS office's that are attached to police stations for charging decisions. They all will detail the policy of, no evidence to support allegation. No charge, no conviction. It seems that most if not all in the justice system, would try to get away with abusing the process of criminal policy one way or another, as there's no-one to supervise their ill actions when the abuse takes place. The Judge should be aware, by how the case is been conducted. The Jury can be tricked into thinking they have heard evidence, when all they have heard is repeated hearsay. As for the prosecutor??, lawyers already should be aware of the process breach. If these criminal justice workers are not adverse to adhering to coded policy, or even have an understanding of the terms of the coded acts and policies which govern hearsay, also to which types of hearsay are inadmissible as evidence. As ones word against another is firstly purely hearsay. If there is no evidence to support the hearsay only statements, eg. to paper or recording of the allegation. Charged and indicted on hearsay only. A CRIMINAL CASE CANNOT GO AHEAD PURELY ON ONES WORD AGAINST ANOTHER, as that is hearsay, and an Abuse of Process. Ask any reasonable CPS adviser before going to court. By the way, Thanks Ms Bowen your a truthful person, as Keir Starmer thinks the public interest can be considered when there's no evidence to support the allegation. With him at the helm, no wonder innocent persons get jailed when there's no evidence the police could find that proves suspects are guilty. Then, have they not proved by coded police policy the person innocent.

Transcript: Welcome to Mary Monson Solicitors. If you call us, there are a few things that you'll be able to expect from whichever lawyer you speak to. The first of those is that its going to be a friendly person that you're going to speak to, who is going to be sensitive to your needs as a client, sensitive to the issues that you think are important. The second thing is that person will be an excellent lawyer. Someone who really knows their stuff and is able to apply that to the individual circumstances on your case, on your behalf. And the third thing is that this is a person who will be committed to achieving the result that you want. Most legal cases contain this in common - clients are going into a situation where they don't necessarily have specialist expertise but its incredibly important that they get the thing right. Its our job to make sure that happens. What is it being a solicitor? And what is it running a solicitor's practice? We look beyond the legal transaction and we ask ourselves - what is it that this person is trying to achieve? And that means, more than anything, listening to them. We have to focus on the client, we have to focus on what that particular person needs from this particular transaction. We are trying to deliver a legal service which operates within the context of moral values. And that means - integrity, duty and respect. The staff need to be looked after. The lawyers here need to be treated with respect by the management of the firm. I have an open door policy with my staff. They can come to me anytime and I am always there ready to offer advice. Everyone who sails on our ship, as I call it, will feel that they are part of a family. In that way, if they are happy working, then they will be able to deliver the service we want, and deliver the care to our clients that I require. The reality is that in most law firms the ethos is about making money. That's not the focus of our law firm. Of course we are a commercial organisation, so money is important, in the same way that money is important to a family who has to pay the bills. But at the same time, our focus in reality is making sure that we're building a good business. And the way you do that is by doing a very good job for clients. Its the spirit of the firm. I know exactly what it is when I see it in action and I think clients feel it as well, and certainly I know that the staff do.
